Beyond Workers’ Comp
Most on-the-job injuries are covered by Workers’ Compensation insurance, which pays medical bills and part of your lost wages. However, you generally cannot sue your employer.
The “Third-Party” Exception: If your injury was caused by a third party (not your employer or a coworker), you may file a personal injury lawsuit in addition to your workers’ comp claim.
- Example: You are a delivery driver (at work) and another driver hits you. You get Workers’ Comp AND you can sue the other driver.
- Example: A piece of equipment malfunctions due to a manufacturing defect. You can sue the manufacturer.
